SB 384: Sex Offense Registration Removal
SB 384 establishes 3 Tiers for registration as a sex offender in the state of California. When the bill goes into effect in January 2021, low-level offenders may be removed from the registry after a designated time period, while violent, high-level offenders will continue to be required to register for life.
- TIER ONE is the least severe category. Example: public indecency. Offenders can petition to be removed after 10 years.
- TIER TWO is for mid-level convictions. Example: engaging a victim in sexual activity through bribery or intimidation. Offenders can petition to be removed after 20 years.
- TIER THREE is reserved for the most severe convictions. This tier covers most types of sexual assault. Offenders are subject to registration for life.
Removal from the registry is not automatic! Registration will continue to be mandatory within 5 days of the offender’s birthday unless they take action. A Tier 1 or 2 registrant may petition the California criminal and juvenile courts for removal from the registry, which will be approved or denied based on individual factors of the offender in question.
